CHAPTER 409
SUBPOENA
409.01 When and How Issued
A subpoena may be issued in a criminal proceeding for the attendance of a witness at a hearing or
trial before the Court, or it may also command the person to whom it is directed to produce the
books, papers, documents or other objects designated therein. The subpoena shall be signed by
the Clerk of Court under the seal of the Court. The subpoena shall command each person to
whom it is directed to attend and give testimony at the time and place specified in the subpoena or
to produce the books, papers, documents or other objects designated therein. The subpoena shall
bear the signature of a judge of the Court.
409.02 Service
A Subpoena may be served by any person, eighteen (18) years or older, upon the person named in
the subpoena by delivering a copy thereof to such person and shall provide proof of service..

409.03 Contempt
Failure to obey a subpoena without adequate excuse is a contempt of court.
